As the fight in the Senate over Judge Neil Gorsuch’s confirmation rages on, Democrats just delivered a major blow to the process.
By most everybody’s standards, Gorsuch is an astute jurist who’s one of the best nominees President Trump could have chosen to fill the late Antonin Scalia’s seat. However, Democrats have vowed to block his confirmation any way they possibly can because, as California Sen. Kamela Harris explained, “legalisms” are more important to Gorsuch than people’s feelings.
In other words, he’s too legal-y to be a Supreme Court justice.
So in the spirit of blocking literally everything the president has tried to do, Senate Democrats have been able to whip enough votes to ensure that Gorsuch won’t be confirmed in the traditional manner, either a straight up and down vote or a 60-vote majority if someone calls for a filibuster.

Several senators announced their opposition to Gorsuch on Monday ahead of a Senate Judiciary Committee vote. The new Gorsuch foes bring the number of Democrats willing to block his nomination to over 40 – the number needed to prevent the Senate from ending debate and advancing to a final vote.
Among the latest to come out against Gorsuch were Sen. Dianne Feinstein, D-Calif., top Democrat on the Judiciary Committee, as well as Sens. Chris Coons, of Delaware, Patrick Leahy, of Vermont, and Mark Warner, of Virginia.
“Despite his impressive academic credentials, Judge Gorsuch’s record and evasive responses – even refusing to answer questions regarding his views of cases like Roe v. Wade and Citizens United – do not give me confidence that he possesses a judicial philosophy that will serve the American public well,” Warner said in a statement.
Keep in mind that normally you wouldn’t want a prospective justice to answer how they’d rule on a particular case before hearing the facts because that’s the equivalent of picking the winner first, then only addressing the facts that support the conclusion you’ve already come to. In other words, Democrats are upset that Gorsuch will actually follow the law and weigh all the facts of a case when he rules on it, rather than looking at the parties involved and picking a winner based upon how he feels about them.
So now, Senate Republicans are left with only one option to confirm Gorsuch, and thanks to Democrats doing the same so they could fast-track Barack Obama’s radical lower court appointments, they’re well within their rights to do so – pull out the nuclear option and change the Senate rules to allow for a simple majority to pass him through. In fact, they should nuke the Democrats until they vomit uranium and then nuke them some more for good measure.
Their obstruction has been unprecedented, so the response should be unprecedented as well.
